Does Melbourne Cup Day move a Payday Super deadline?

No. SuperDue does not count Melbourne Cup Day (Tuesday 3 November 2026) as a non-business day. Several Victorian councils observe a different day instead, so it is not a public holiday for the whole of the state. Leaving it out can only make a deadline earlier, never later.

The rule in one paragraph

A business day is any day other than: a Saturday or Sunday; a day that is a public holiday for the whole of any Australian state or territory. […] If a public holiday applies to only part of a state or territory (for example, Royal Hobart Show Day), that day is still a business day for Payday Super purposes. ATO, Payment deadlines for Payday Super (QC105846), "Definition of 'business day'"

Melbourne Cup Day is the case that test was written for. The Public Holidays Act 1993 (Vic) s 8 lets a non-metropolitan council have another day appointed that replaces Cup Day in its area, and several did for 2026 (Greater Geelong, Greater Bendigo, Warrnambool, Moyne and Wodonga among them). In those areas 3 November 2026 is an ordinary working day, so the day is not a holiday for the whole of Victoria. The full reasoning, with the WA King's Birthday that works the same way, is in the public holidays guide.

The paydays it affects in 2026

These are the paydays whose 7-business-day window runs across Tuesday 3 November. Each date is the day the fund must receive the contribution, and it is the same in every state and territory — there is no per-state Payday Super deadline.

PaidFund must receive byDay-by-day count
Fri 23 Oct 2026Tue 3 Nov 2026Paid Friday 23 October
Thu 29 Oct 2026Mon 9 Nov 2026Paid Thursday 29 October
Fri 30 Oct 2026Tue 10 Nov 2026Paid Friday 30 October

Two things are worth noticing in that table.

  • A Friday 23 October payday is due on Cup Day itself. Because the day counts as a business day, it is the seventh business day after the payday. In the parts of Victoria that take the holiday, that is the day the contribution has to be in the fund.
  • If a tool gives you one day later, it is counting Cup Day. Thursday 29 October would become Tuesday 10 November and Friday 30 October would become Wednesday 11 November. Those later dates are the ones the Act does not support.

Each linked page shows the count day by day, the send-by date with a default clearing-house buffer, and the 20-business-day date for a new or rehired worker. The due dates around public holidays index lists every other 2026–27 payday a holiday moves.

What about 2027?

Cup Day 2027 falls on Tuesday 2 November 2027 and is treated the same way: as a business day. If the ATO publishes a statement that a substituted holiday still counts as a holiday for the whole of the state, SuperDue will change both years and say so on the changelog.

Check your own payday: the free deadline checker needs no account and shows every holiday it skipped. The 2026–27 calendar has every weekly, fortnightly and monthly run already worked out.
